Please read these terms carefully before using RockSteady.

Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and RockSteady ("we," "us," or "our") governing your access to and use of the RockSteady mobile application and website (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

Description of Service

RockSteady is a fitness tracking application that allows users to:

  • Log and track workouts, cardio sessions, recovery activities, and sports activities
  • Set and monitor fitness goals
  • View progress statistics and history
  • Connect with friends and share activities through social features
  • Track outdoor activities using GPS
  • Create custom exercises and workouts

The Service is intended for general fitness tracking and motivation purposes only. It is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the Service under applicable laws
  • If you are under 18, you have parental or guardian consent to use the Service

Account Registration

To use certain features of the Service, you must sign in with your Apple ID through iCloud. By doing so, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your Apple ID credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, incomplete, or violates these Terms.

User Conduct

When using the Service, you agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Harass, abuse, threaten, or intimidate other users
  • Post or share content that is offensive, defamatory, obscene, or infringes on others' rights
  • Impersonate any person or entity or misrepresent your affiliation
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers/networks connected to it
  • Use automated means (bots, scrapers) to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Remove or alter any proprietary notices or labels on the Service
  • Use the Service to collect or harvest user information without consent

User Content

You retain ownership of any content you create, upload, or share through the Service ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to share your User Content
  • Your User Content does not violate any third party's intellectual property, privacy, or other rights
  • Your User Content complies with these Terms and all applicable laws

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.

Social Features

The Service includes social features that allow you to connect with other users, share activities, and interact with others' posts. When using social features:

  • You control what you share and with whom
  • You are responsible for the content you post
  • You agree to interact respectfully with other users
  • You understand that shared content may be visible to your approved friends

We are not responsible for the actions, content, or data of other users. You agree to release us from any claims related to other users' conduct.

Health and Safety Disclaimer

IMPORTANT: RockSteady is not a medical application. The Service provides fitness tracking for informational and motivational purposes only.

  • Always consult a physician before starting any new exercise program
  • Do not rely on the Service for medical decisions
  • Listen to your body and stop exercising if you experience pain, dizziness, or discomfort
  • The workout recommendations and tracking features are general in nature and may not be appropriate for everyone

You assume all risks associated with your use of the Service and any exercise or fitness activities you undertake. We are not liable for any injuries, health issues, or other damages that may result from your use of the Service or participation in fitness activities.

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by RockSteady and are protected by copyright, trademark, and other intellectual property laws.

The RockSteady name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use these marks without our prior written permission.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.

Third-Party Services

The Service may integrate with or contain links to third-party services, including:

  • Apple iCloud and CloudKit for data storage
  • Apple HealthKit for health data integration (with your permission)
  • MapBox for route mapping

Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROCKSTEADY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Personal injury or property damage
  • Service interruption or computer damage
  • Any damages arising from your use of or inability to use the Service

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless RockSteady and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Your User Content

Modifications to Service and Terms

We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice. We also reserve the right to modify these Terms at any time.

We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. For material changes, we may also notify you through the app or via email.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

Termination

You may stop using the Service at any time by deleting the app from your device. You may also request account deletion by contacting us.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination will survive.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against us.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RockSteady regarding the Service and supersede all prior agreements and understandings.
